Deceptive Advertising
Advertising
is an essential element in the branding and marketing of a corporation.
Companies spend a significant percentage of their marketing
dollars to communicate a precise message about their products
and/or services to customers, potential customers and the marketplace
in general. In return, this target audience depends on the companies
to ensure these messages are truthful, accurate and not misleading.
The same is true for comments on or suggestions about competitors.
Deceptive advertising by a competitor can undermine a company's
reputation in the marketplace, causing the injured company untold
losses in revenues, in reputation and in momentum and morale.
Deceptive advertising is a method of unfair competition and
is prohibited by federal law. The Lanham Act provides a federal
statutory basis for companies to pursue remedies for deceptive
advertising.
Our attorneys are experienced in counseling our clients on establishing
procedures for avoiding deceptive advertising and in evaluating
possible advertising initiatives. We also defend our corporate
clients' reputations in a court of law as necessary.
