The following is a representative list of Professional Liability & Ethics Litigation handled by DiMuro, Ginsberg & Mook, PC:
Obtained a $1.2 million verdict for a plaintiff in legal malpractice
case against attorney for mishandling woman's case against doctor
for misdiagnosis of breast cancer. Physician had missed the
diagnosis of breast cancer -- the proper diagnosis was not made
until 16 months later. By the time the correct diagnosis was
made, plaintiff's disease had progressed from curable to non-curable.
The defendant attorney prosecuted the case against the doctor
and was prepared to proceed to trial when he lost the original
mammograms that were the critical evidence in this case. As
a result, the case against the doctor was lost. This legal malpractice
case followed. (Circuit Court of Alexandria)
Represented physician and holder of the drug patent to reverse
effects of Alzheimer's disease in $25 million fee dispute with
his prior law firm. Case transferred to another jurisdiction
before trial. (City of Alexandria Circuit Court)
Represented client against former attorney in a legal malpractice
claim arising from real estate transaction. Client had lent
landowner $1 million to forestall foreclosure of horse farm
at the behest of local real estate agent (the attorney's son).
Attorney (who had been recommended by son to complete the transaction)
failed to advise client of extreme risks of transaction, failed
to perform due diligence on land records and failed to properly
document transaction. Landowner went into default and client
(lender) incurred significant legal costs arising from the subsequent
years of litigation. Client alleged that attorney favored interests
of son who was in severe financial distress and would realize
a significant commission if transaction closed . Settled during
trial. (Circuit Court of Fairfax County)
Represented plaintiff business in legal malpractice claim for
business losses arising from the law firm's negligent filing
of wireless television license applications with Federal Communications
Commission. Attorney had conflicts of interest because he represented
competing applicants for licenses. Settlement after four days
of trial. (U.S. District Court for the Eastern District of Virginia)
Represented client against attorney arising out of divorce case.
Attorney had failed to preserve alimony rights in final divorce
decree. Settled before trial. (Circuit Court of Alexandria)
Represented attorney in defense of legal malpractice case where
attorney had failed to comply with statute of repose in a personal
injury case.
Provided expert testimony in numerous legal malpractice cases.
