Americans with Disabilities Act
The Americans
with Disabilities Act ("ADA") is a comprehensive federal statute
designed to "provide a clear and comprehensive national mandate
for the elimination of discrimination against individuals with
disabilities." Since July 26, 1994, all employers with 15 or
more employees must comply with the ADA. In addition, the ADA
does not preempt state claims, such as state tort claims, that
provide greater remedies than are available under the ADA. With
respect to state laws prohibiting discrimination on the basis
of disability, the most stringent of the two standards will
determine the level of compliance which must be met by the employer.
